Hata Affiliates - Rules

Hata Affiliates is a referral programme that rewards users who refer other users (“the Programme”). Alongside Hata’s Terms of use and Privacy policy, you agree to these Rules when participating in the Programme.

Affiliate programme details

Hata users who successfully onboard onto our platform are automatically given a unique affiliate code and link (“Affiliate Code“) which can be used to refer new users (“Referees”) to Hata. When this Affiliate Code is used by a Referee to sign up with Hata and such Referee successfully onboards onto our platform, the referee and referring user (“Affiliate”) will share 20% of the Referee’s trading fees (if the Referee trades on our Hata Exchange) or Instant Buy/Sell fees (if the Referee conducts an Instant Buy or Instant Sell transaction) (collectively, “Fees”) in the following proportions:

  • Affiliate - 10% of the Fees; and
  • Referee - 10% of the Fees.

The term “transaction“ in these Rules or the Programme now includes transactions on the Instant Buy/Sell in addition to transactions on the Hata Exchange, unless otherwise specified.

For the avoidance of doubt, only transactions on Hata’s Exchange or Instant Buy/Sell feature are included under this Programme. All other features or products are excluded from this Programme.

For the avoidance of doubt, rewards are only earned on net fee-generating transactions after refunds, chargebacks, or reversals. We reserve the right to adjust reward calculations to exclude artificially inflated or collusive trading activity.

Eligibility

Participation in the Programme is restricted to verified users who comply with Hata's Terms of use. The following categories of users should take note of whether they will be eligible to participate in the Programme:

  • If a user did not apply an Affiliate Code within 30 days from their signup date, they will not be able to use someone else’s Affiliate Code after this 30-day period. However, they may continue to share their own Affiliate Code with other Referees.
  • If a user has already applied an Affiliate Code during their signup process, they will not be able to apply someone else’s Affiliate Code. However, they may continue to share their own Affiliate Code with other Referees.

If a user has already applied a Buddy Bonus code during their signup process, they will not be able to apply someone else’s Affiliate Code. However, they may continue to share their own Affiliate Code with other Referees.

For the avoidance of doubt:

  • Referees can only redeem one (1) Affiliate Code when signing up with Hata. Referees who apply a Hata user’s Affiliate Code will become a Referee of that Hata User across all platforms that the Referee has successfully onboarded to. For example, if a Referee has successfully onboarded onto Hata Malaysia and Hata Global and proceeds to then redeem an Affiliate Code, the Referee’s qualifying transactions on both Hata Malaysia and Hata Global platforms will generate rewards for the Affiliate whose Affiliate code was redeemed by the Referee.
  • Referees will not be able to apply an Affiliate Code originating from another user who signed up later than the Referee.
  • Referees who wish to apply an Affiliate Code during their signup process must ensure that they use the correct Affiliate Code either by entering it accurately, or by using the correct link provided by their preferred Affiliate. Once the signup process has been completed, the applied Affiliate Code cannot be changed or amended. Any errors or inaccuracies in the applied Affiliate Code will result in the Referee being unable to apply the correct Affiliate Code, and the corresponding benefits will not be granted to the desired Affiliate.

We may retroactively disqualify any user or transaction from the Programme if participation violates these Rules or applicable, even if previously rewarded.

Nontransferable

Affiliate Codes are assigned uniquely to each eligible Hata user. An Affiliate Code is non-transferable, cannot be sold or given to another person, and cannot be exchanged for cash or any other cryptocurrencies, except as specified within these Rules.

Rewards generated by Referees’ transactions are nontransferable between Affiliates’ accounts across platforms. What this means is that if an Affiliate has onboarded to both Hata Malaysia and Hata Global and has obtained rewards on his/her Hata Malaysia account, these rewards cannot be transferred to the Affiliate’s Hata Global account.

Reward Estimation and Payment

Eligible users may view an estimate of their potential rewards under this Programme on their Hata Account’s dashboard (“Estimate”). The Estimate is provided for informational purposes only and does not constitute a guaranteed amount for payment. The actual payout may differ based on factors such as transaction volume, processing fees, and other Programme conditions. Rewards will be paid in the respective units of fiat currency or crypto based on the nature of the transaction that a Refereee has initiated (i.e. whether it is a buy or sell transaction).

For example:

  • If a Referee uses fiat currency to initiate a buy-transaction and receives crypto in return (whether on our Hata Exchange or Instant Buy/Sell), the corresponding trading fees or Instant Buy/Sell fees will be charged in crypto. Accordingly, the amount of Fees shared between the Affiliate and Referee will be calculated and paid in crypto.
  • If a Referee uses crypto to initiate a sell-transaction and receives fiat currency in return (whether on our Hata Exchange or Instant Buy/Sell), the corresponding trading fees or Instant Buy/Sell fees will be charged in fiat currency. Accordingly, the amount of Fees shared between the Affiliate and Referee will be calculated and paid in fiat currency.

Based on the above, users will receive their proportion of Fees either in fiat currency or crypto depending on the types of transactions undertaken by an Affiliate’s Referee(s). Please note that regardless of the denomination of Fees paid to Affiliates and their Referees, the Estimate displayed on the dashboard of users’ Hata Accounts will be denominated in fiat currency for users’ ease of reference.

We may withhold or adjust payments pending investigation of suspicious activity. Users forfeit rewards if Referee transactions are reversed or deemed manipulative (e.g. circular or wash trades).

Payment

The rewards generated by such Referees’ transactions shall only be allocated to the Affiliate’s Hata account on the same Hata platform where the Referee’s transaction occurred. Please see the illustrations below for further context.

Example 1:

  • A Referee has successfully onboarded onto Hata Malaysia only and has applied the Affiliate Code of an existing Affiliate. The Affiliate has already onboarded to both Hata Malaysia and Hata Global.
  • The rewards generated by such Referee’s transactions on Hata Malaysia shall be paid into the Affiliate’s Hata Malaysia account only. These rewards will not be paid into the Affiliate’s Hata Global Account.

Example 2:

  • A Referee has successfully onboarded onto Hata Global only and has applied the Affiliate code of an existing Affiliate. The Affiliate has already onboarded to both Hata Malaysia and Hata Global.
  • The rewards generated by such Referee’s transactions on Hata Global shall be paid into the Affiliate’s Hata Global account only. These rewards will not be paid into the Affiliate’s Hata Malaysia account.

Example 3:

  • A Referee has successfully onboarded onto Hata Global only and has applied the Affiliate code of an existing Affiliate. The Affiliate has only onboarded onto Hata Malaysia.
  • The Affiliate will not receive any rewards into his/her Hata Malaysia account.
  • The same outcome shall apply vice versa (i.e. if a Referee onboards onto Hata Malaysia and the Affiliate has only onboarded onto Hata Global).

Each Affiliate and Referee’s proportion of shared Fees will be paid into their respective Hata wallet, either in fiat currency or crypto as set out in Paragraph 4 above.

Unless expressly stated otherwise, Hata will pay the Affiliate and Referee their respective proportion of shared Fees, all of which are exclusive of any applicable taxes, where applicable.

Any tax imposed by any government, statutory, or tax authority shall be borne by the Affiliate or Referee, as the case may be. If Hata is required by any government, statutory, or tax authority to withhold taxes from its payments and remit such taxes to the local taxing jurisdiction, then Hata will pay the net amount after the taxes have been withheld and provide to the Affiliate or Referee a copy of the official tax receipt upon request.

If the Affiliate or Referee breaches any of its obligations under Hata’s Terms of Use or Rules under this Programme, Hata reserves the right to withhold any payment due to the Affiliate or Referee and to recover from the Affiliate or Referee any amount of the payments that Hata had previously made to the Affiliate or Referee before such breach.

If a user breaches these Rules, we may:

  • Deduct improperly earned rewards from such user’s account balance;
  • Pursue legal recovery of paid-out rewards; or
  • Terminate all future payouts, including for legitimate Referrals.

Prohibition of Abuse

Users are strictly prohibited from engaging in any form of abuse, manipulation, or fraudulent activity in connection with the Programme. This includes, but is not limited to:

  • Creating or attempting to create fake or duplicate accounts (including “shell accounts”) to generate artificial referrals;
  • Using stolen or synthetic identities to participate in the Programme;
  • Referring oneself through alternate accounts (i.e. “self-referrals”)
  • Using automated systems, bots, or scripts to artificially inflate referral activity;
  • Exploiting system vulnerabilities to alter referral tracking or reward calculations;
  • Misusing Hata’s name, logos, or branding on social media, websites, or other platforms to falsely imply an affiliation with Hata, or deceive users into believing that the abuser’s platform is Hata’s official sign-up page/portal, or alternative sign-up page/portal;
  • Creating imitation websites or social media profiles that mimics Hata’s official channels to harvest referrals;
  • Making false or misleading claims about the Programme’s benefits (e.g. guaranteed profits, exaggerated rewards, etc.);
  • Offering incentives to third parties in exchange for fraudulent signups;
  • Purchasing, selling, or trading Affiliate Codes or Hata Accounts;
  • Sharing Affiliate Codes in spam emails, unsolicited messages, or prohibited forums;
  • Coordinating with other users to systematically exploit referral rewards (i.e. referral rings);
  • Misrepresenting the Programme or misleading potential referrals; or
  • Engaging in any activity that violates our Terms of Use or applicable laws;

Hata reserves the right to investigate suspected abuse using manual reviews, automated tools, or third-party services. During this investigation, we may review user transactions, request documentation, and suspend any applicable payouts to users. If abuse is detected, we may:

  • Suspend or terminate an Affiliate or Referee’s participation in the Programme;
  • Withhold, reclaim, or void any portion of shared Fees that have been paid out to Affiliates or Referees;
  • Restrict access to our services; or
  • Pursue legal action for damages, or violations of applicable laws.

Users may report suspected abuse by submitting a ticket to support.hata.io.

Programme Duration

The Programme shall commence on the date of its release and continue unless terminated or modified by Hata in accordance with this paragraph. Hata reserves the exclusive right, at our sole discretion and without prior notice, to:

  • Shorten, extend, or terminate the Programmes’ duration;
  • Modify eligibility criteria, referral structures, or any other Programme terms;
  • Pause or discontinue the Programme in whole or in part (e.g. by product or user segment).

Where practicable, Hata will provide advance notice of material changes (e.g. via email, platform notifications, or updated Rules). However, we may enforce immediate changes where required by law, security, or operational necessity.

Termination of the Programme shall not affect any accrued rewards earned prior to termination (subject to existing terms), our rights to recover improperly claimed Fees, or liabilities arising from a breach of these Rules.

Users’ participation in the Programme does not create a vested right to future sharing of Fees or Programme availability. Users acknowledge that Hata’s discretion under this paragraph is absolute and binding.

The termination or expiry of the Programme shall not affect our right to recover improperly claimed rewards or enforce penalties for breaches that occurred prior to termination.

General Amendments

We reserve the sole and absolute right to modify, suspend, or terminate the Programme or any aspect of the Programme at any time, with or without cause and with or without notice. Any such changes shall be effective immediately for security, legal or operational necessities, or upon prior notice (where practicable) through our official communication channels.

Your continued participation in the Programme after any changes take effect constitutes binding acceptance of the modified terms. No user shall have any claim or entitlement based on prior versions of these Rules, and. class action / representative action suits are waived.
